SCOTUS slams the door on the GOP

Yesterday the Supreme Court delivered a strong message to Republicans’ attempt to overturn Biden’s victory in the state of Pennsylvania. The Court, strongly controlled by jurists handpicked by the GOP, denied the request in a one-sentence, unanimous decision.

 

By the latest count, this means that the Republicans have lost about 50 challenges to the Biden/Harris victory. While the claims have been many (foreign powers hacking the voting system, ballots improperly counted, etc.), there has been zero evidence to support the claims. The state of Georgia confirmed Biden’s victory three separate times.

 

Federal judge Stephanos Bibas, sitting on the federal appeals court in Philadelphia, recently wrote a scathing opinion rejecting the GOP claims:

“Free, fair elections are the lifeblood of our democracy.”

“Charges of unfairness are serious. But calling an election unfair does not make it so.”

“Charges require specific allegations and then proof. We have neither here.”

“Voters, not lawyers, choose the president.”

“Ballots, not briefs, decide elections.”

Will this finally put an end to the attempts by the Republicans to attack the Biden/Harris victory? Of course not.

 

Texas Attorney General Ken Paxton (who has been under indictment since shortly after his election and is the subject of a DOJ investigation for bribery in his office), filed in the Supreme Court on behalf of the State of Texas against Georgia, Michigan, Pennsylvania and Wisconsin to allege those states engaged in election irregularities, and asked the Court to enjoin the use of the alleged unlawful election results. Not one legal scholar gives this suit any merit.

 

In fact, the State of Texas lacks standing to complain about the election results in another state. Best comment of the day about Paxton’s suit came from Richard L. Hasen, a law professor at the University of California, Irvine, who called the Texas filing a “press release masquerading as a lawsuit.”

 

Republicans love to tout local control and states’ rights until they want to meddle.

Lawyers who file frivolous lawsuits without any legal merit are subject to substantial sanctions. Unfortunately, AG Paxton has governmental immunity. What he does not have immunity from is the voters of Texas.

 

Texas is a big and powerful state. It continues to be important to focus on flipping the state because of the influence it has across the country.
